Welcome to Marathon Buddy! These Terms of Service ("Terms") govern your access to and use of the Marathon Buddy mobile application (the "App"), provided by Marathon Buddy ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Marathon Buddy.

2. Eligibility

You must be at least 13 years old to use the App. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have your parent or legal guardian's permission to use the App.

3. Account Registration

To access certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account

4. License and Restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes.

You agree NOT to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Use the App for any illegal or unauthorized purpose
• Interfere with or disrupt the App's functionality
• Attempt to gain unauthorized access to our systems

5. Health and Medical Disclaimer

By using the App, you acknowledge and agree that:

• Consult Healthcare Professionals: Before starting any training program, consult with a qualified healthcare provider, especially if you have pre-existing health conditions, injuries, or concerns.
• Training at Your Own Risk: You assume all risks associated with using the training plans and features provided by the App.
• Not Medical Advice: The App's recommendations, training plans, and VDOT calculations are for informational and educational purposes only.
• Listen to Your Body: You are responsible for monitoring your own physical condition and adjusting or stopping training if you experience pain, discomfort, or injury.
• Emergency Situations: In case of medical emergency, call emergency services immediately. Do not rely on the App for emergency assistance.

6. Intellectual Property Rights

The App and its entire contents, features, and functionality are owned by Marathon Buddy and are protected by international copyright, trademark, and other intellectual property laws.

7. Subscription and Payments

The App may offer both free and premium (paid) features. Premium features require a subscription, which may be offered on a monthly, annual, or other basis.

Payment Terms

• Subscriptions are billed in advance on a recurring basis
• Subscriptions automatically renew unless canceled before the renewal date
• Payments are processed through Apple App Store or Google Play Store
• Refunds are subject to App Store and Google Play Store refund policies

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers and Limitations of Liability

9.1 "AS IS" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARATHON BUDDY SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Personal injury or property damage resulting from your use of the App
• Any damages arising from training activities or following training plans

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Termination

You may terminate your account at any time by deleting your account through the App settings or contacting us. We may suspend or terminate your access to the App immediately, without prior notice, if you violate these Terms.

11. Dispute Resolution

Before filing a claim, you agree to contact us at support@marathonbuddy.app to attempt to resolve the dispute informally. We will attempt to resolve disputes within 60 days.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.
